End User Licence Agreement

This End User Licence Agreement ("Agreement") governs the use of the Power BI custom visual Compensation Explorer (the "Visual"). The Visual is published by Alexander Hilbrig, using the Workforce Studio brand, Rosenheimer Straße 72, 81669 München, Germany (the "Licensor"), email ask@workforce-studio.com. By installing, importing or using the Visual you accept this Agreement on behalf of yourself and, where applicable, the organisation you represent. If you do not agree, do not use the Visual.
1. Licence grant
The Licensor grants you a free-of-charge, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use the Visual within Microsoft Power BI, in the hosts Microsoft supports for custom visuals, for your own and your organisation's internal business purposes.
2. Restrictions
- Do not modify, translate, decompile, disassemble or reverse engineer the Visual, except to the extent mandatory law permits this regardless of this restriction.
- Do not remove or alter any notices contained in the Visual.
- Do not redistribute, sell, rent or lend the Visual outside the Microsoft distribution channels and your organisation's own visual store.
- Do not use the Visual's name, logo or assets to market another product.
The source code of the Visual is not licensed. "Free" means free of charge, not open source.
3. Distribution through Microsoft
Where you obtain the Visual from Microsoft AppSource, the Power BI visuals marketplace or your organisation's visual store, Microsoft's terms for those services apply in addition. Microsoft is not a party to this Agreement and gives no warranty for the Visual.
4. Your data and your responsibility
The Visual processes the data Power BI supplies to it inside the report host. It makes no external network requests, sends no telemetry and stores nothing outside the report. You remain responsible for the lawfulness of the data you process with it, for permissions and sharing inside Power BI, and for supplying compensation amounts and references on a comparable basis. 5. Nature of the outputs
The Visual's outputs are descriptive and depend entirely on the data and references you supply. Pay-gap figures are unadjusted comparisons. They are not a causal, legal or statutory assessment, for example under EU Directive 2023/970 or national pay transparency law, and do not replace review by qualified personnel.
6. Updates, support and availability
The Licensor may publish updates and may change or discontinue the Visual at any time. There is no obligation to provide updates, support or any particular availability. Support is offered by email on a best-effort basis without a response-time commitment.
7. Intellectual property
The Visual, including its code, design, documentation and assets, remains the property of the Licensor and its licensors. This Agreement does not transfer any ownership.
8. Warranty
The Visual is provided free of charge and "as is". To the extent permitted by law, the Licensor gives no warranty as to its freedom from defects, its fitness for a particular purpose or its uninterrupted availability. The Licensor is liable for defects only where a defect was fraudulently concealed.
9. Liability
The Licensor is liable without limitation for intent and gross negligence, and for injury to life, body or health. As the Visual is provided free of charge, any further liability is excluded to the extent permitted by law. Where mandatory law requires otherwise, liability for slight negligence is limited to the breach of material contractual obligations and to typical, foreseeable damage. Mandatory statutory liability, including under product liability law, remains unaffected.
10. Term and termination
This Agreement takes effect when you install or first use the Visual and runs until terminated. You may terminate it at any time by removing the Visual. The Licensor may terminate it if you breach this Agreement. On termination you must stop using and remove the Visual. Sections 2, 7, 8, 9 and 11 survive termination.
11. Governing law and jurisdiction
This Agreement is governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a merchant, a legal entity under public law or a special fund under public law, the courts of München, Germany have exclusive jurisdiction.
12. Changes and contact
The Licensor may publish a revised Agreement together with a new version of the Visual. The version of this Agreement published at this address when you install a given version of the Visual applies to that version. Earlier versions are available on request.
